Low-Flying Planes coming tomorrow AM

Hi all! Need your help. I am looking for any legal matters that dealt with low-flying planes and death of your deer...and, unfortunately, I need it fast. WI DATCP are scheduled to come tomorrow a.m. to fly over our 11 acres of pens that hold 85 deer so they can spray for gypsy moths because our measley 5 trees are in their area of spraying.



We have so far contacted help from influential people in HIGH places but with the little time given to clear up this matter, they may not get back in time to help stop the spraying at least over our pens.



We have been told by the contact number provided on their notification postcard and email that we should "put livestock inside" or "be out there with them." We have 7 fawns on the ground as count from this morning with 23+ doe in their 195th day of gestation.



So, any help would be great!



Also, they said they had to come back for a 2nd spraying in 5-7 days...I guess that's to clean up any surviving deer? I know, not funny. I'm just overly worried sick.

Video the whole scene. So you have Prof if you need to seek restitution. I had a crop duster come over last year and it didn't even bother them. Hopefully it wont take long and the pesticide wont hurt your deer. If the trees are on your property just go cut them down and then they wont have to spray.
 
My attorney wrote a CYOA letter to DATCP to notice them of my intentions if any deer are damaged at all. Hopefully they'll at least postpone until we get cleared from their area of concern. I have had my camcorder charged and ready since last week with "before" pictures being taken tonight. I will let you all know tomorrow. Maybe we should have a section/thread for prior cases dealt with in court for us to go to in times like these?
 
We had an incident of a low flying plane and we were able to get the numbers off of it - it was that low. We lost a couple of deer that crashed into the fence. Turns out the plane was a DNR plane surveying some beaver dams behind our place. We filed a claim with the state but lost our claim. They said there weren't any witnesses and we couldn't prove that was why the deer died. We heard later that very few claims are ever affirmed.



So not sure what to tell you to do - have witnesses and if a deer dies have the cause documented.
 
i used a [potato cannon to deter helicopters flying too low over my pens. Expect a vi9sit from FFA and ATF if you do the same.
 
If they are calm bottlefeds be sure to be standing out there with them throwing treats and such. That might keep them occupied long enough for them to pass over!!!
 
I hope everything works out for the best. We have had a couple incidents here with low planes over the pens and my deer are all bottle fed and calm but they didn't like those planes at all!

I wish you the best.....my deer don't have a choice there is a small airport next to my farm and the planes fly over low everyday....they are small jets so they make a lot of noise.......it doesn't bother them now....I have purchased deer and knock on wood never had any issues with them crashing the fence because of the planes......but I am sure it happens.......good luck I hope it works out!
 
Here is an article that I found on a local news site. This is a Federal Law that is being referred to. I know this probably doesn't help beforehand but may be of use after the fact.



We have crop-dusters over our pens every year and it absolutely drives me crazy. So far we haven't lost any deer but it's just a matter of time before we do. They seem to show up here in July, just imagine the damage these planes could cause if they ran our velvet antler bucks into the fence that time of year.

I had a plane over my pen's last year at about 75 feet high, the deer went nut's. I did get the plane to leave but was soon called by the local police.
 
Update: Yesterday I did not hear anything from anyone about what actually happened at DATCP/DNR level but I guess mid afternoon it was decided in conference that we be put on the pilot's "no-fly list" even though we were scheduled as first place to spray come sunrise. I found out by an office angel that made sure I could sleep last night and that cared about the herd and that had access to the email circulated on that.



We are not people that get into politics but, let me tell you, Gov. Scott Walker's office had a helping hand in putting a stop to this. Now at least we have time to work something out...which as of this morning we have. The plan right now is we will let the plane fly higher above and circle down until at the level he wants to spray at in order to give the deer a chance to get used to the sound. If the deer start getting too nervous, my husband motions to someone else who will radio the pilot and they'll have to come up with some other way to spray.



Communication works wonders but I wish this would have been taken care of right at the first time we called. It should never get to the point of us bringing in the governor, our attorney with a threatening letter and disturbing Dr. Kroll for his opinion. But I will update you again after they try flying over...trust me, I will be filming! And for prepping, my son is cutting the grass.
 
You got the best Gov in the whole world.....he has done exactly what he was voted in to do.....and now you watch....he will be replaced....I surely hope not...I can only pray it does not happen....we need someone like him in the oval office.....someone that just wants to get the job done and does not worry about re election........I'm glad things are looking up for you...hope it all works out!!
 
That is good news! As for being political, now is the time for all good men.... As the saying goes to step up. Please vote in both the primary on May 8, and the election on June 5 to keep our governor. This is the first business friendly governor we've had in a long time!!!!!
 
We did a second spraying and I sent thank you cards with brownies to Gov. Walker's office and my attorney's office. Then I followed up and sent a thank you card with a packet of flowers and personal invite to our farm to the two DATCP employees that actually came here to help communicate with the plane from the ground - they were awesome as well. Hopefully this event will prove to DATCP deer farmers are people that strive to work together also but towards the best outcome and to we only want our livestock safe from harm.



We are spreading the word on the Governor's active role in this like wildfire :0) Hopefully it adds more votes in his favor!
