Iowa DNR Motion to Stay Denied; Brakke's Win!

 

On February 13, 2015, the Iowa District Court of Polk County announced their Ruling on Petition for Judicial Review. The Ruling reversed the prior agency action, thereby invalidating an Emergency Order served to Tom & Rhonde Brakke by the Iowa Department of Natural Resources. The emergency order required the Brakke’s to maintain the perimeter fence on their property until December 28, 2017.

 

The Iowa DNR subsequently filed a Motion to Stay, among others, all of which have now been denied by the court.

 

This marks a long-awaited victory for the Brakke family and the cervid industry.


 


 
 
Huge win!

Property that is enclosed by a high fence that gets a CWD positive deer cannot be treated differently than a property that has a CWD positive without fence. We know some things now that CWD is not. Fifteen years ago we ask for a CWD program as an industry. We need to trash the current program! It is outdated.
 
I agree Jonathan. What are we accomplishing besides putting people out of business. If we could control it in the wild it would be different. If 99% of bucks are shot at 2&3 most would not live to show signs. And with the study showing that human protein sequence doesn't allow humans to get cwd, things appear much different than 15yrs ago. We don't know what it is but we know what it is not.
