main e-mail at the bottom, in the second

2 paragraph there, I believe Dr. __________ had a

3 conversation with Dr. Norden. Who is Dr.

4 Norden?

5 A. Dr. Norden's -- Dr. Dianne Norden's

6 with USDA Veterinary Services.

7 Q. What is her position with USDA?

8 A. Her exact entitlement I'm not sure,

9 but she's involved with the TSE programs.

10 Q. TSE's governing scrapies, CWD, TSE?

11 A. Yes.

12 JUDGE: All right. I'm sorry,

13 what are those programs?

14 THE WITNESS: Her primary role is with

15 Chronic Waste Disease and scrapie program.

Q. And in there it states that Dr.

19 _____ conversation with Dr. Norden, since

20 this was intrastate movement of animals -- I

21 guess I should say the first sentence there

22 regarding movement from the Clear Lake Farm to

23 the Davis County Hunting Preserve, Dr. Norden

24 said that since it was intrastate movement of

25 the animals, the USDA has no problems with it if

1 the state chooses to do so. It is a state

2 determination but we'd need several stipulations

3 including -- and then it had some other

4 requirements.

5 Is it your understanding that the USDA

6 would not have objected to intrastate movement

7 of the Brakkes' whitetail deer?

8 A. Yes.



Our initial offer to the state with USDA stamp of approval, but still denied movement . . . . didn't even know this email existed until our third day in court.
 
Under oath by state official:



A. In the State of Wisconsin they have large

20 numbers as far as in wild whitetail deer in their

21 state and they've had CWD for a much longer period

22 of time, and it's my understanding that when it's

23 opening hunting day in Wisconsin it's a holiday.
