dogs in deer pen

Neighbors dogs got into my deer pens yesterday and killed some of my deer. Wrecked antlers on a bunch of yearling bucks. Alot of my pregnant does had cuts on there faces and neck from hitting the fence. The dog owner called me to tell me they were in there and apologized. I drove straight there to check it out to discover the carnage. I called her back to tell her the results and to tell her we would need to sit down and figure this all out. She apologized again. My lawyer told me that i had a air tight lawsuit against them but there home owners insurance would cover the animals and they would just have to talk to there adjuster and make a claim they would only b out there deductible. When i relayed the news to her the next day she said that the dogs were only in the pens for 2 minutes and there was no way that they could do all that damage. I would like some opinions from other deer farmers on what kind of damage 2 dogs can do in just two minutes when deer are in a frantic panic repeatably hitting the wire. Please give your expert opinions so i can print them off and include this information in my file for my civil suit against them.

In two minutes I would think that all the deer in that pen could be dead or injured. Depending on the size of the pen. I have had dogs run the length of my pen along the road and 3 of my 6 does were cut up from hitting the fence.
 
A dog does not even need to be in the enclosure to kill the deer, they will just run them into the fence from the outside. Matt is right on and I have had many calls about that very thing. Todd, this should be a no brainer for any judge as long as you have proof it was her dogs, that is gonna be key I feel.
 
Todd - Two minutes of dogs being in a deer pen of average size is MORE than enough time to kill and/or injure every deer in there...NO DOUBT!



Furthermore, as Matt and Henry have mentioned, dogs don't have to be actually inside a deer pen to do grave damage to the deer, ie kill and/or injure every deer inside the pen. Running the perimiter is all the dogs need to do to kill every deer in there.



Get a police report filed ASAP, and look into the ''Dogs running at large'' law in your area. You might want to consider having your local dog catcher write your neighbor a ticket to help bolster your case. Check with your lawyer on the necessity of that...you don't want to spoil your relationship with your neighbor, yet you need to do what you need to cover your butt/loss.

Document, document, document. When you are done with that, document what you have documented. Take pictures, lots of them. Get the law involved, get a police report.



Dont think it is as easy as them just turning it into their insurance company and you get a check. I just went through this for 13 1/2 months. Dogs killed my deer on April 30, 2011 and I still dont have a check in my hand. When the insurance company finds out how much they are worth, they will FIGHT you. Insurance companies have no idea what our deer are worth and when they find out, they think you are running a scam. They will have to be educated!!



Plan on that you are going to court with all the evidence you are getting now, it will definitely help you out later.

sorry for your loss..make sure your lawyer knows there are deer farmers that will back you up in court on values of whitetail deer..you can go to sale results and get values of what deer sold for with the same pedigrees..hopefully your neighbor will help back you on your loss.. it takes no time for killing deer when they are scared, they hit a fence very hard and fast, as you said their faces and necks showed the results..get all the pics you can of the animals and the fences where they hit..there are a lot of farmers out there that has had the same problem, hopefully they will read this and let you know their results and give any help they can..again sorry for your loss Boyd at atypicalwhitetails.com
 
WELL, if she has already aknowledged the fact that the dogs were in your deer pen for a period of 2 minutes, that is all you need. The majority of the damage can be caused by the deer being scared and trying to get away. The presence of the dog IN THE PEN is what is important. It should be a matter of setting a value of the animals now.



I filed a claim last year with my local electric company. They had hired a helicopter to fly around the local powerline right-of-ways to trim trees. They told him of my deer farm and to stay away from my property. Apparently someone didn't listen. They repeatedly flew over my deer pens, scaring my deer. I lost 2 does from this incident. They did settle with me for exactly what I asked for. I won't post on here any details, but you can PM me or call if you'd like to know more.
 
Sorry to hear about your troubles. I had some dogs circle my pens early this year but never got in. They mananged to kill 4 of my 10 yearling buck fawns by running them into the fence. So, just as someone else mentioned dogs can do a lot of damange in a short period of time even without getting into the pens. Stay firm and make sure you get what is owed to you! Good Luck!
