Wondering if I have any Options?

Hello, I'm sure everyone is going to tell me what I already know but I thought I would ask the question and see if anyone had any good ideas for me. I recently bought I straw of Hydro Ax off Whitetail Exchange from a seller and when my vet unthawed it to use it this fall for AI it exploded and was ruined. My vet told me it is not uncommon for this to happen but it is rare. She said usually the sire owner will be happy to replace the straw. Unfortuntely for me I did not buy this straw from Mark and when I asked the individual I bought it from to replace it I was ignored. The person I bought it from said they had bought it from another seller. I asked the seller to help me out and at least try to make it right. Now no one answers the phone or returns emails. I'm not sure what the rules are on transactions like this but I know that I would replace the straw or return the buyers money if this happened to me. Maybe this is just bad luck on my end and I should accept it and move on, what do you think?
 
It's always difficult when you purchase something like semen 2nd or 3rd hand. You can't hold the original owner responsible because of semen handling and changing hands. The seller likely doesn't have another straw to replace yours. Don't think there's any right answer, just a tough situation to deal with.

I hate to say it but you are screwed. I learned to never buy a straw unless it is straight from the farm that owned the deer. Because you never know how the straw was handled. Also in the farm that sold the straw to you defense, they probably purchased the straw for decent money and were just trying to generate some revenue from it because they were not going to use the straw. So since the straw was not from a buck that they owned they can't replace it.......now again in their defense....they could give you your money back....but.....how do they know that it's not something that you may have done to cause the straw to explode? not saying you did but just trying to look at it from both sides. I feel bad for you Brett as I know the feeling cause I have been there an done that......I don't feel it is right for them to not be answering their phone ....but in all honesty I don't think there is a whole lot they can do for you.........just my humble opinion. Kind of repeated what mike said above we were posting at the same time.
 
Brett was the straw ever moved in any of these transactions??? If the straw was owned by say 3 owners but it never left say great lakes facility the original owner might help you out!! It would be a very,very nice thing for him to do but it sure should'nt be expected. I had a straw of maxfli owned by john ward that i purchased off the exchange and it exploded. Mind you it was the first straw i ever laid my hands on and was going in my first deer i was breeding myself for the first time. I had no vet to fall back on to say i didnt handle it wrong,Which i dont believe i did. Anyways a phone call to john just to ask if he had this problem before with any straws and his answer was no but that he would be more than happy to replace it. He not only sent one but sent two on his dime with his own shipper. Thats what i say going above and beyond and is another reason he sees me as a repeat buyer!!! Good Luck!!!
 
If I was the original owner and I had extra straws in the tank I would replace it. With that being said it is best to buy derect or at least get some kinda gaurantee. Buying second or third hand you probly got a way better deal than buying from the farm and this is the chance you take. if I was selling second hand semen I would say you are buying as is. This is the gamble you take when not buying from the farm.
 
Brett, You might talk to Todd @ the Whitetail Exchange and see if they can help you get something worked out! But I would say you are probably just out the money for the straw since you bought it after it had changed hands several times.

In other post on here, someone ask if they could hear something nice done instead of all the bitching, so here goes. Brett, if the original owner does not replace it or if the seller does not refund your money, then I will GIVE you a 2012 doe fawn out of my Hydro Ax daughter (if she has a doe fawn). She was live bred on Nov. 26th. She usaually fawns the last of May or a couple of days into June. Good Luck, Jeff
 
Wow! Jeff I'm not sure what to say. That is incredibly generous of you! I can't tell you how much I appreciate your offer. I truly hope you don't take offense but I cannot accept your offer. It was not your fault at all what happened and I wouldn't feel right accepting your gift. Thank you very much for your consideration though.
 
I too have said a few things on here that I should not have said. But it doesnt bother me to speak my mind. It seems to piss off more people when the truth is spoken for some reason. But did you notice, only two comments for offering something nice. It is human nature to enjoy drama and argue about things more than to show appreciation for something nice. Making friends is a hell of a lot more important than losing a deer. I get way more laughs being with friends than being with deer, and I'm sure you all do. Anyway, HAB thanks for the comment, very nice of you. Brett, my offer still stands if you want her, I have plenty of other does, Good Luck, Jeff

Hey Brett - Hope you don't think I'm sticking my nose where it doesn't belong, but allow me to shed a bit of a different light on Jeff's generous offer.

I too sometimes struggle with accepting people helping me out, I think many of us do. It truly is ''better to give than to receive'', so in fact, when we refuse someone's help we are actually stealing their blessing. Hey...it just feels good to give. This truth/concept has certainly helped me to receive from others. I believe Jeff will be blessed by you accepting.

Jeff - We need more people in the world like yourself.

The 2012 fawns will be out of this 2 year old buck. He is out of a Marty Graw daughter. Thats Marty Graw as Grandpa on the top and Hydro Ax as Grandpa on the bottom.

Thank you for your input. Your probably right, it wold be rude of me to reject Jeff's king gesture and so I've changed my mind. Jeff, if your offer still stands I would be honored to accept. If your doe has female please at least allow me today for bottle feeding though? Thank you
