CWD Standards

Dear Producers:

We are hoping that you have had a chance to find a copy of the Standards for your own personal review.

In our case here in Iowa, the Standards will make legal what the state of Iowa is doing to us. It gives Iowa the ammunition they need to quarantine our 330 acre hunting preserve for 5 years now that it is depopulated.

More importantly, the Standards only provide the "minimum requirements" AND like the rule, gives the states the right to shut you down, take your poperty or close their borders if they so chose. Specifically stating that the expenses are to be shared by the producer and the state. Taking all responsibility off of the USDA.

We ask you, to find a copy of the standards and review them for yourself. You cannot have your cake and eat it too. Either you support our lawsuit for compensation and the taking of our property unjust or your support the standards which give the government the right to do the same to you or your neighbor.

Thank you again for your consideration.

Brakke Letter To The Cervid Industry

Tom and Rhonda Brakke

Wow Rhonda, What a compelling story!

I have read the standards this week and don't understand how we will survive with these in place. This is a death wish for the industry. But what do you expect with the wildlife agencies involved with writing this program, then getting themselves exempted from it. Patty Kline, from APHIS, USDA, said at our meeting at NADEFA, we could throw the program out if we liked. I think we need to take her up on her offer.

One of the problems I see with the standards is, the states are required to accept these as their minimums. If states want to relax their programs, they won't be able too. Our state vet was talking, at our state banquet last weekend, about dropping our testing requirements possibly down to 50%, but with the federal program we won't be able to do it. As he said, after 10+ years of testing at 100%, at some point testing becomes redundant. We also were just testing brain stems, now we are required to turn in both brain stem and lymph node.

I hope breeders will wake up and take the effort to read the standards for themselves. This WILL effect everyone. Your story could be their's tomorrow!

Gary,

Sad but true. The photographs speak volumes about the disease. Amazing how healthy our positive bucks looked just prior to being harvested. Even with minimum contamination, the new Standards give the authority to quarantine our preserve with less than 1% infection rate. I only hope that the members find a copy of the standards and find a united voice so that no other producer or preserve will be treated as we are now.

Rhonda,

I hope every state and national association is distributing your letter to their membership.

It is unacceptable to approve these standards. We as an industry cannot allow it. Approving them and "working them backwards to fix them later" makes no more sense than asking congress to pass a ban on ALL firearms and "just fix it later so it applies to only assault weapons." It is a strategy that makes no sense. We cannot accept these standards and set this precedent.

Seriously folks......enough is enough already!!.....How can we turn a blind eye to what is going on anymore......YES IT CAN HAPPEN TO YOU!!! this makes me Ill to see what is happening........we are treated like we are doing something that is illegal.......we might as well be growing marijuana instead of Whitetails........cause we are certainly being treated the same just short of a jail sentence!!! IT IS TIME WE TURN TAIL AND FIGHT! When backed into a corner there is no other choice!!.The Brakkes love what they do...And so do we!!...it is being stolen from them and we CAN'T LET IT HAPPEN! If this doesn't make you want to Fight for what you know is right....you don't belong in the business of deer farming as far as I am concerned! We need to donate till we can't afford to donate anymore towards a class action suit!!.....and we need to TELL our representatives we want to take legal actions against all the unrealistic regulations being imposed upon our Industry!! We can't just sit back and watch any longer.......i don't care if it is the NADefa.......ACA...or whom ever........but this is the route we need to

take......nothing else works.......I am glad to see the brakkes have gone this

route........if one of these organizations is willing to take this route....who is

willing to donate.........I would pledge $500.00........towards a legal action to

our rights? Anyone else??

By the way......I am not the type to sue someone...have never done it to date and don't feel it is the course to take until ALL other options are exhausted...and I feel our options have been exhausted!!

The first step is to do something about the standards or we have no grounds to stand. We can't agree to live with these standards then try to sue them for it...

Rhonda

Coming from Montana I know what you and Tom are going thru.Hopefully our industry will figure out soon that enough is enough

Thank you all for your support. We just want everyone to be absolutely sure what our animals looked like prior to being harvested and the treatment we have received since. Everyone needs to have their eyes wide open to the reality of finding CWD and expected treatment by our government.

Wind Cave did a second round of release of CWD exposed/infected animals and have now reported releasing 400 animals in total. So double standards . . .

That's crazy.......I am tired of takin........I just don't see how we can't unite! It is a slam dunk if we took the right course......I stress IF!

God forbid it happens but what if the first lawsuit makes it through the system and the state wins against the industry. Where would other states take that win?

Yes, that is a risk that not only the industry faces, but Tom and I face personally. So are u expecting us to just walk away from our investments?

With that suggestion, Mike or Angie, how can u or anyone encourage a new producer to make any investment in this industry? Good luck, I wish u a CWD free life and maybe we will get our back too.

The lawsuit has already been filed. We HAVE to win this one. We all have skin in the game here. It is SO important we support Brakke's on this. They are willing to take on OUR fight for US. Even emotional support goes a long way!!

So what if we loose !! We are loosing the battle every day here, we have everything to gain and really nothing to loose ! We are loosing the battle by just sitting on our a$$ 's and doing nothing too !! It's been a loosing battle for the last 10 years , and it will remain a loosing battle if we don't do SOMETHING !!

There are no suggestions!!! I would not invite anyone in the way it stands now. Just not sure if just one lawsuit is enough at one time. Some of the federal rule is crazy but ya know..I believe all states are still doing business with it. We are not, Have not since Oct 2012. None in. None out and no inside movement. Now thats a rule. One rule you still do business. A state rule and i am locked down like i am the one with cwd.

Has anyone ever heard the song by Twisted Sisters titled "we're not gonna take it anymore"? That needs to be our new theme song. God forbid the Brakke's lose their lawsuit but even if they lose, we win because we are finally showing the government that we are done laying down. We're not gonna take it anymore!

Rhonda Brakke said:
Okay, so are the standards going to help u regain movement or commerce?

Thats not stopping our movement at this time. Its the CWD in Pa and the lack of paperwork to know who, where and when deer were moved. We are locked down by the tracebacks. So they say!

Most of the federal rule has always been the norm for Ny. Tagging, Testing, Yearly inventory. We have had those since day one!

Im not sure one lawsuit in one state is enough. I think they need to see the Shock Effect...(Yur welcome Steve) with suiys coming in left and right.

Bottom line is that they are never going to pay us for any losses....We have seen what kind of shape our country is in. Heck they are making Govt workers on base take an unpaid day off every week up here... We can hope to get some changes made but like i have seen the hard way...The states can make the federal rule look like a cake walk and we will all have to work with our states one way or the other... They really can shove the bat if they like. I have many up here begging for us to file lawsuits and i agree but it seems like we might need a mutiny to get it done!

There are two potential answers to this question: 1) roll over and quit, or 2) appeal the decision. A loss at the state level doesn't mean it's the end of the line; heck, a win at the state level doesn't mean it's the end of the line. The question is: Who is gonna flinch first?
